TL;DR: Yes, you can sell a house in Arkansas without a realtor, but a represented buyer's agent is still typically paid: $9,702 on Benton County's $385,000 median sale price for the first half of 2026 (Arvest Skyline Report, University of Arkansas Walton College CBER). That figure uses Redfin's 2.52% national average for homes under $500,000 in the quarter ending September 2025. Selling alone removes the listing agent's fee. On Washington County's $362,000 median, the buyer-agent line is $9,122.40. You still carry disclosure, lead paint, deed, and closing duties yourself.
Can you sell a house in Arkansas without a realtor?
Yes. Ark. Code 17-42-301(a) requires a license to act as a real estate broker or salesperson, but Ark. Code 17-42-104(a)(1)(A) exempts an unlicensed owner acting on his or her own interest in the property. The exemption covers the owner, not an unlicensed helper paid to act for you (17-42-301(b)). Plan to handle the listing, showings, negotiation and contract yourself.
Nationally, this is the rare path. For-sale-by-owner homes were 5% of U.S. home sales over the year ending June 2025, an all-time low. 91% of sellers used an agent, a record high (NAR 2025 Profile of Home Buyers and Sellers, November 2025). The same report put the median FSBO sale price at $360,000 against $425,000 for agent-assisted sales nationally. Those are national figures, not a local forecast.
Northwest Arkansas adds its own geography: Walmart is headquartered in Bentonville, Tyson Foods in Springdale, and J.B. Hunt in Lowell. In the first half of 2026, houses sold in Bentonville averaged $549,317 over 123 days, Rogers $551,767 over 85 days, Fayetteville $432,635 over 95 days, and Springdale $383,360 over 98 days (Arvest Skyline Report (University of Arkansas Walton College CBER); these are averages, not medians). If you are pricing in one of these cities, compare your house to its city row rather than the county figure.
How much does selling without an agent save in Benton and Washington County?
The most concrete number is the buyer's agent fee. Redfin reported an average buyer's agent commission of 2.42% nationally for the quarter ending September 2025, and 2.52% for homes under $500,000. Both county medians are under $500,000, so 2.52% is the relevant tier.
Benton County's median sale price for houses sold in the first half of 2026 was $385,000 (Arvest Skyline Report (University of Arkansas Walton College CBER)). Multiplied by Redfin's under-$500,000 rate: $385,000 x 0.0252 = $9,702. Washington County's median was $362,000, so $362,000 x 0.0252 = $9,122.40.
That is the buyer-side portion only. Selling alone removes the listing agent's fee, but it does not automatically remove the buyer's agent's pay: a represented buyer still has to settle how their agent is paid, and NAR's rule changes took effect in August 2024.
If you own a median-priced home in Benton County, the buyer-agent line is roughly $9,702 you may offer, negotiate down, or leave to the buyer to cover. Decide that before you list.
What does the local market look like for an owner selling alone?
Start with how many homes compete with yours. Benton County had 2,441 active listings in September 2026, up from 1,832 in September 2025, and Washington County had 1,157, up from 896 (Realtor.com via FRED). More inventory means more homes competing with yours.
For pricing, keep the periods straight. The Realtor.com median listing price was $460,600 in Benton County and $399,563 in Washington County in September 2026, and those are asking prices. The median sold price for houses in the first half of 2026 was $385,000 and $362,000 (Arvest Skyline Report (University of Arkansas Walton College CBER)). Price from the sold data, not from the asking-price level.
Time matters too. Houses sold in the first half of 2026 averaged 115 days on market in Benton County and 101 in Washington County (Arvest Skyline Report (University of Arkansas Walton College CBER)). Listings active in September 2026 had a median of 72 days in Benton County and 61 in Washington County (Realtor.com via FRED), which measures how long listings sat, not how long sales took.
Compare your monthly carrying costs over 101 to 115 days against what selling alone saves; they can exceed it.
What paperwork does an Arkansas seller carry without an agent?
Four items stay with you. First, condition disclosure: the state of Arkansas does not require property condition disclosure by every seller, according to an undated Arkansas Real Estate Commission column by Gary Isom, but Realtors strongly encourage all sellers to complete the Seller Property Disclosure form. Completing it protects you by putting what you know in writing.
Second, lead paint, which is mandatory for most pre-1978 homes. Federal rules require you to give buyers the Protect Your Family From Lead In Your Home pamphlet, disclose known lead-based paint and hazards, hand over available records, and include a Lead Warning Statement in the contract. Buyers get a 10-day inspection period unless it is changed or waived, and you keep a signed copy for three years (U.S. EPA).
Third, transfer tax. Arkansas charges $3.30 per $1,000 of actual consideration (Arkansas DFA Real Property Transfer page, viewed 2026-10-29), and unless the parties agree otherwise the seller pays half (Ark. Code 26-60-106, as of 2026-10-24). On a Benton County sale at the $385,000 median, your half is $635.25; at the Washington County median of $362,000 your half is $597.30. Both prices are already whole thousands, so no rounding up is needed. The DFA lists an Affidavit of Compliance form and a transfer tax stamp purchase form.
Fourth, deed and title work. Ask the circuit clerk and the title company for the exact deed form and current recording fees before you sign a contract.
If you are selling alone, build a folder with these four items before the first showing.
How do taxes and timing affect what a buyer pays and what you keep?
Arkansas property is assessed as of January 1. When a home sells, the assessor reassesses it at 20% of appraised value on the next January 1 after closing (Act 2284 of 2005), and the new owner gets no Amendment 79 limitation on assessed value until the second assessment date. A resale buyer budgets price x 20% x overall millage, the same as new construction. Tax payments run from the first business day in March through October 15, with a 10% penalty after (UAEX).
For your own proceeds, Arkansas exempts gain on a personal residence up to $250,000 per taxpayer, or $500,000 for a married couple filing on the same return, and taxes 50% of a net long-term capital gain above that, if you owned and lived in the home as your principal residence for at least two of the five years before the sale (Arkansas DFA 2025 AR1000F/AR1000NR instructions and AR1000D). The homestead credit is up to $600 on a homestead, your principal residence, for 2026 bills, and $675 on a homestead for assessment year 2026 and later under Act 174 of 2026 (Arkansas DFA Property Tax Relief page and Act 174, as of 2026-10-23); it affects your own bill, not the buyer's.
If you want buyers to understand their costs, give them the formula rather than your bill. That keeps a buyer's agent from questioning a number you cannot support.
What Should You Do With These Numbers?
- Start with your median: $385,000 in Benton County or $362,000 in Washington County (first half of 2026). Then apply Redfin's 2.52% under-$500,000 average (quarter ending September 2025) to see the $9,702 or $9,122.40 buyer-side figure you would be deciding about.
- Decide in advance whether you will offer any buyer-agent compensation, since a represented buyer will ask.
- Price against sold figures, not listing prices: Benton County's median listing price was $460,600 in September 2026 against a $385,000 sold median (first half of 2026).
- Fill out a written seller property disclosure (Arkansas Realtors strongly encourage the Seller Property Disclosure form, though state law does not require one), and assemble the lead paint package if the home predates 1978.
- Ask your title company for the deed form, recording fees, and transfer tax stamp process, and budget your half of the tax: $635.25 on the Benton County median or $597.30 on the Washington County median.
Frequently Asked Questions
Is it legal to sell my own house in Arkansas without an agent?
Yes. Ark. Code 17-42-104(a)(1)(A) exempts an owner acting on his or her own interest in real estate from the license requirement in 17-42-301(a). You must still follow disclosure, lead paint, deed, and tax requirements, which an agent would otherwise manage. The exemption covers the owner, not an unlicensed helper paid to act for you.
Do I have to give a property disclosure when selling by owner in Arkansas?
No law requires every Arkansas seller to disclose property condition, according to an undated Arkansas Real Estate Commission column by Gary Isom. Realtors strongly encourage all sellers to complete the Seller Property Disclosure form, though it is voluntary. Federal lead-based paint disclosure is mandatory for most pre-1978 homes, regardless of who sells.
How much commission can I save selling without a realtor in Benton County?
Selling without an agent removes the listing agent's fee, so ask any listing agent you interview to quote that rate in writing and compare it. The buyer-agent line that may remain is the 2.52% average for homes under $500,000 (Redfin, quarter ending September 2025). On Benton County's $385,000 median sale price for the first half of 2026, that line is $9,702.
Who pays the Arkansas transfer tax in a sale by owner?
Unless the parties agree otherwise, the seller pays half and the buyer pays half. The tax is $3.30 per $1,000 of actual consideration. On the Benton County median of $385,000, the seller's half is $635.25 (Ark. Code 26-60-105 and 26-60-106, as of 2026-10-24).
